06.最低工资(Minimum wages)

    重点内容:劳动者有获得最低工资保障的权利,用人单位有执行最低工资保障规定的义务。用人单位与劳动者签订劳动合同时约定的工资待遇,用人单位实际支付给劳动者的工资待遇,均不得低于所在区县(自治县、市)执行的最低工资标准。

    适用情形:本市行政区域内的各类企业、个体经济组织和与之形成劳动关系的劳动者。

    依  据:1. 《最低工资规定》(劳动和社会保障部令第21号);

    2. 《重庆市最低工资保障规定》(重庆市人民政府令第106号);

    3. 《重庆市职工权益保障条例》。

    重点内容:1. 万州区、黔江区、涪陵区、渝中区、大渡口区、江北区、沙坪坝区、九龙坡区、南岸区、北碚区、渝北区、巴南区、长寿区、江津区、合川区、永川区、南川区、綦江区、大足区、璧山区、铜梁区、潼南区、荣昌区、开州区、梁平区、武隆区、两江新区、重庆高新区、万盛经开区职工最低月工资标准为2100元/月,非全日制职工最低小时工资标准为21元/小时;

    2. 城口县、丰都县、垫江县、忠县、云阳县、奉节县、巫山县、巫溪县、石柱县、秀山县、酉阳县、彭水县职工最低月工资标准为2000元/月,非全日制职工最低小时工资标准为20元/小时。

    适用情形:我市辖区内的企业、个体经济组织、民办非企业单位等组织和与其建立劳动关系的劳动者;国家机关、事业单位、社会团体和与其建立劳动关系的劳动者;依法成立的会计师事务所、律师事务所等合伙组织、基金会和与其建立劳动关系的劳动者;不完全符合确立劳动关系情形的新就业形态劳动者。

    依  据:《重庆市人力资源和社会保障局关于发布重庆市最低工资标准的通知》(渝人社发〔2021〕52号)。



Minimum wages


    Highlights: Staff and workers are entitled to minimum wages, and employers have the obligation to implement minimum wages. The wages and benefits agreed upon by the employer and the employee when signing employment contracts, and the wages and benefits actually paid by the employer to the employee shall not be lower than the minimum wages enforced by the counties (autonomous counties and cities) where they are located.

    Scope of application: All types of enterprises and individual economic organizations within the administrative areas of Chongqing and the employees who have formed labor relations therewith.

    Legal basis: 1. Provisions on Minimum Wages (No.21 Decree of the Ministry of Human Resources and Social Security of the People's Republic of China);

    2. Provisions of Chongqing Municipality on Minimum Wages (No. 106 Order of Chongqing Municipal People's Government);

    3. Regulations of Chongqing Municipality on the Protection of the Rights and Interests of Employees.

    Highlights: 1. In Wanzhou District, Qianjiang District, Fuling District, Yuzhong District, Dadukou District, Jiangbei District, Shapingba District, Jiulongpo District, Nan'an District, Beibei District, Yubei District, Ba'nan District, Changshou District, Jiangjin District, Hechuan District, Yongchuan District, Nanchuan District, Qijiang District, Dazu District, Bishan District, Tongliang District, Tongnan District, Rongchang District, Kaizhou District, Liangping District, Wulong District, Liangjiang New Area, Chongqing New-Tech District, and Wansheng Economic and Development Zone, the minimum monthly wage for employees is RMB2,100, and the minimum hourly wage for part-time employees is RMB21;

    2. The minimum monthly wage for employees in Chengkou County, Fengdu County, Dianjiang County, Zhongxian County, Yunyang County, Fengjie County, Wushan County, Wuxi County, Shizhu County, Xiushan County, Youyang County, and Pengshui County is RMB2,000, and the minimum hourly wage for part-time employees is RMB20.

    Scope of application: Enterprises, individual economic organizations, and non-governmental non-profit organizations, and the staff and workers with whom they have established labor relations within the jurisdiction of Chongqing; State organs, public institutions, and social groups, and staff and workers with whom they have established labor relations; accounting firms, law firms and other partnership organizations and foundations established in accordance with the law and the staff and workers with whom they have established labor relations; and a new kind of employees who do not fully meet the criteria for establishment of a labor relationship.
