09.工作时间及加班工资(Working hours and overtime pay)

    重点内容:1. 国家实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度;

    2. 用人单位应当保证劳动者每周至少休息一日;

    3. 企业因生产特点,经劳动行政部门批准,可以实行其他工作和休息办法;

    4. 用人单位由于生产经营需要,经与工会和劳动者协商后可以延长工作时间,一般每日不得超过一小时;因特殊原因需要延长工作时间的,在保障劳动者身体健康的条件下延长工作时间每日不得超过三小时,但是每月不得超过三十六小时;

    5. 有下列情形之一的,用人单位应当按照下列标准支付高于劳动者正常工作时间工资的工资报酬:(1)安排劳动者延长工作时间的,支付不低于工资的百分之一百五十的工资报酬;(2)休息日安排劳动者工作又不能安排补休的,支付不低于工资的百分之二百的工资报酬;(3)法定休假日安排劳动者工作的,支付不低于工资的百分之三百的工资报酬。

    适用情形:在中华人民共和国境内的企业、个体经济组织(以下统称用人单位)和与之形成劳动关系的劳动者,适用本法。国家机关、事业组织、社会团体和与之建立劳动合同关系的劳动者,依照本法执行。

    重点内容:用人单位安排职工在法定休假日、周休息日工作或者延长工作时间,应当在不违背国家规定的前提下,坚持职工自愿和不损害职工身体健康的原则。确因生产经营需要,或特殊原因需要延长工作时间的,延长工作时间每日不得超过三小时,但是每月不得超过三十六小时。违反国家规定强迫职工加班加点,职工可以拒绝,用人单位不得因此扣发职工工资和解除与职工的劳动关系。用人单位安排职工在法定休假日工作或者延长工作时间,应当按照规定发放加班加点工资;安排职工在周休息日工作的,应当按照规定安排相应的补休,确实不能安排补休的,应当按照规定发放加班工资。

    适用情形:1. 本市行政区域内的企业事业单位、个体经济组织、民办非企业单位、国家机关和社会团体等用人单位的职工权益保障,适用本条例。国家公务员以及依照和参照国家公务员制度管理的人员除外;

    2. 本条例所称职工,是指与用人单位建立劳动关系 的劳动者(含进入城镇就业的农村劳动者)。

Working hours and overtime pay


    Highlights: 1. The State implements a system under which the daily working hours do not exceed eight hours and the average weekly working hours do not exceed 44 hours;

    2. Employers shall allow their employees to have at least one day off each week;

    3. Enterprises may, with the approval of the labor administration, implement other work and rest methods according to the characteristics of production;

    4. Employers may, for reasons of production and operation and after consultation with the trade union and employees, extend the working hours, which in general shall not exceed one hour per day; if the working hours need to be extended for special reasons, the extension shall not exceed three hours per day, totally thirty-six hours per month at most, and shall do no harm to employees' health;

    5. In one of the following circumstances, the employer shall pay the remuneration higher than the wages of normal working hours to the employee in accordance with the undermentioned standards: (1) if the employee is arranged to work overtime, the remuneration shall not be lower than one 150% of the employee's salary; (2) if the employee is arranged to work on the day of rest and it is not possible to take deferred holidays, the remuneration shall be 200% of the employee's salary at least ; (3) if the employee is assigned to work on statutory holidays, the remuneration shall not be less 300% of the employee's salary. 

    Scope of application: The present Law shall apply to enterprises and individual economic organizations (hereinafter collectively referred to as "employers") within the territory of the People's Republic of China and employees who have formed labor relations therewith. State organs, institutional organizations and societies as well as employees who form an employment contract relationship therewith shall follow this Law.

    Highlights: Employers who arrange for employees to work on statutory holidays and weekly rest days or extend their working hours shall adhere to the principles of employee voluntariness and no harm to their health without prejudice to State regulations. If it is indeed a requirement for extra working hours due to production and operation or for special reasons, it shall not exceed three hours per day and shall not be more than 36 hours per month. In case of forced work overtime against State regulations, the employee may refuse, and the employer shall not therefore withhold the employee's wages or terminate the labor relationship established with the employee. In case of arrangement for work on statutory holidays or extended working hours, the employer shall be pay overtime wages according to law; in case of work on weekly rest days, they employer shall provide the employee with compensatory leave according to law; if it is indeed impossible to arrange for compensatory leave, the employer shall pay overtime wages as required by law.

    Scope of application: 1. The present article shall be applicable to the protection of the rights and interests of employees in enterprises, public institutions, individual economic organizations, non-governmental non-profit organizations, State organs, social groups, and other employers within the administrative areas of Chongqing. This excludes civil servants and those who are managed in accordance with and by reference to the national civil service system;

    2. The employees referred to in the present article are those who have established labor relations with their employers (including rural people coming to towns and cities to find jobs).
