72.人力资源服务许可(“告知承诺”制)(Human resources service license ("Notification and Promise" system))

    改革方式:实行告知承诺:申请人承诺已具备法定条件的,经形式审查后当场作出审批决定。

    适用范围:改革措施适用于住所地在重庆市的企业法人。对于存在严重不良信用记录的企业,在信用修复前,不适用告知承诺制办理该项行政许可。

    审批层级:1. 市级:外资、港澳台资、中央驻渝所属单位、市属单位及市外单位在重庆市设立的人力资源服务机构;

    2. 区县级:其他(除市级审批外)在重庆市设立的人力资源服务机构;自贸区内设立的外资、港澳台资性质人力资源服务机构,应当向自贸区相关职能部门申请许可。

    法律依据:1. 《中华人民共和国就业促进法》;

    2. 《人力资源市场暂行条例》;

    3. 《重庆市人力资源市场条例》。

    许可条件:1. 有明确的机构章程和管理制度;

    2. 有开展业务必备的固定场所、办公设施和一定数额的开办资金;

    3. 有一定数量具备相应职业资格的专职工作人员。

    2. 承诺书。

Human resources service license ("Notification and Promise" system)


    Reform mode: Implementation of the notification and promise system: If the applicant guarantees that lawful conditions have been met, decisions on approval are made on the spot after review of the procedural elements of application.

    Scope of application: Reform measures are applicable to legal persons whose domicile is in Chongqing. For companies with serious adverse credit records, the notification and promise system shall not be used to obtain administrative licensing until the bad credit record is repaired.

    Approval level: 1. Municipality level: Human resources service agencies set up in Chongqing by foreign investors, Hong Kong, Macao and Taiwan investors, departments of the central government in Chongqing, municipality-level units, and units outside Chongqing;

    2. District and county levels: Other (except for those approved by the Chongqing government) human resources service agencies set up in Chongqing; foreign-funded, Hong Kong, Macao and Taiwan-funded human resources service agencies set up in China (Chongqing) Pilot Free Trade Zone shall apply for permission from relevant functional departments of China (Chongqing) Pilot Free Trade Zone.

    Licensing conditions: 1. Have clear articles of association and a management system;

    2. Have a fixed place, office facilities and a certain amount of startup capital necessary for conducting businesses;

    3. Have a certain number of full-time staff members with appropriate professional qualifications.
